so for more on what is next i'm joined by nbc justice correspondent pete williams. good morning to you after a very long day. and bravo for your work done yesterday. where do authorities go from here? >> well the justice department says it intends to put tsarnaev on trial in a regular civilian court with all the rules that would apply in any criminal trial. and that is renewing the debate about how to try terrorists on american soil. as soon as he is physically ready dzhokhar tsarnaev will be subjected to questioning by federal authorities. but in the beginning, he will not be given the usual miranda warning about the right to remain silent. instead, the government will invoke a rule that allows questioning a suspect without giving advice of rights. >> there is a public safety exemption in cases of national security, and central charges involving acts of terrorism, and so government has that opportunity right now. >> the government invoked that same rule in the case of the so-called underwear bomber. as in his case, it allows questioning to learn of any potential pl

let's go to pete williams. with a good afternoon to you, pete, let's talk first about the status of the charges in this case and what the likely charges will be. >> yes, i think the odds are pretty good that we'll see these charges in the next couple of hours. they're putting the final touches on them now. and we expect to learn a little more about what the fbi has assembled based on its investigation of the bombing. so perhaps there will be some new details that we'll get. in terms of the charges, i would think at the very least they'll charge him with the bombing, with a terrorism offense for that. and interestingly enough, under the federal statutes, which apply here, use of a weapon of mass destruction, which is the federal law version of what a bomb is, if death results, then that is a capital offense. the government could seek the death penalty. massachusetts is a state that does not have the death penalty. so the only death-eligible charge here would be the federal offense, even though four people were k

pete williams is nbc's chief correspondent. pete, thank you for joining us. i used a movie reference there to try to figure out this radicalization thing. of course, we're learning now a bit about our surveillance. what have we learned in the last day about what we knew in our agencies that we didn't know before? >> well, this has raised a question, i think there's a couple of ways to look at this, chris. one is what the fbi and the cia and the government did. then the second question is, should they have done more? do they have enough legal authority to do more? but in terms of what they did, here's the way it's described to us. the russians come to the fbi in early 2011 and say we think that tamerlan tsarnaev, the older one, and his mother are becoming radicalized. they're coming to russia. we want to know more about them. so the fbi looks through its terrorism databases. doesn't find anything. looks to see if the phone numbers that he has are being called by other terrorists. looks for terrorism connections. finds nothing. goes to the house. interviews tam
